In my state, North Carolina, where I practice, a parent with custody can attempt to terminate the rights of the other parent. (A parent cannot terminate their own rights. I.e. dad can't stand up and say "hey, terminate my rights, I don't want to pay child support anymore") I'm going to be totally politically incorrect here and say that usually this is mom trying to terminate dad who is not around, not paying child support, etc. etc. First you would have to have grounds. Here in NC you'd need to show things like: he has abandoned the child, failed to support the child, abused/neglected the child. I did a termination for a mom where the dad was essentailly just worthless, h adn't seen the kids in a year, hadn't paid his child support in a a year, and probably had drug abuse issues. He didn't even show up for court and the judge terminated his rights. So, if you can prove grounds for termination (and they vary in every state) then you move on to the next question.....Is a termination in the child's best interest? This can be a tough one. If you have a great step-dad waiting in the wings to adopt, this will make the judge's decision easier. For my mom, there was no step-dad waiting, and by ordering the termination, the judge left the child with only one legal parent. Sometimes the judge can be hesitant to do this. The argument goes that two parents are better than one, even if that second one is a really crappy one. If the judge does order a termination, then it would be up to you to file a new action to have your children adopted by their step-father. That would be a simple process. I would go ahead and pay an attorney their consult fe e to get the scoop on what happens in your state.
